*The New Jersey Real Estate Commission requires that the Broker and the Home Buyer must contract for a Rebate at the onset of the Brokerage relationship in a written document, an electronic document or a Buyer Agency agreement. The document or agreement must specify the terms of any Rebate to be credited by the Broker to the Home Buyer. The Broker must provide the document or agreement to the Home Buyer at the outset of the Brokerage relationship. NO REBATE can be given to any Home Buyer without the BROKER's authorization and signature.

*Per New Jersey Real Estate Commission rules, the Rebate must NOT be contingent upon the use of other services or products being offered by a Broker or an affiliate of a Broker.

*The New Jersey Real Estate Commission requires that we recommend that the Home Buyer contact a tax professional concerning the tax implications of receiving the Rebate.

*The New Jersey Real Estate Commission also wants us to include the following: The Home Buyer must pay any applicable taxes for receipt of the Rebate.

*The New Jersey Real Estate Commission requires that we disclose the Rebate payment to the Home Buyer in the Real Estate Contract, to all parties involved in the Transaction, including the Mortgage Lender.

*In the event that the Home Buyer purchases a home listed by RealtyMark Select, the Home Buyer will receive a Rebate only on the commission received by RealtyMark Select on the Buying Side and NOT on the Listing Side of the Transaction.

*Any and all credits will be listed on the HUD settlement sheet under “Broker Credit”. If the “Broker Credit” is not allowed by applicable law, exceeds any Rebate thresholds, or is not allowed by the Lender or the Builder, then the terms of the offer are null and void and any such credit will be forfeited.
